They are used to divide transaction costs and responsibilities between the buyer and the seller, and reflect modern transport practices. They are very similar to the United Nations Convention on Contracts for the International Sale of Goods.

The International Chamber of Commerce (ICC) has been responsible since 1936 for drafting and updating the Incoterms, in accordance with changes that international trade undergoes. The Incoterms 2000 are currently in force. They are set out in the ICC Publication 560
